1. Purpose
These Terms of Use (hereinafter "Terms") govern access to and use of the public site travelyzer.com as well as the Compass by Travelyzer platform (hereinafter "the Platform").
Use of the Platform implies unreserved acceptance of these Terms. In the event of disagreement, the user is invited not to use the Platform.
2. Access to the service
Access to the Platform requires the creation of an agency account, conditional on the conclusion of a commercial contract between Travelyzer SAS and the client agency.
The public site is freely accessible. Travelyzer SAS reserves the right to suspend, without notice, access to all or part of the service for reasons of maintenance, security or technical updates.
3. User accounts
Each user undertakes to provide accurate information when creating their account, to keep it up to date, and to keep their login credentials confidential.
The user is solely responsible for actions performed from their account. Any fraudulent use must be reported immediately to support@travelyzer.com.
4. User obligations
The user undertakes to:
- Use the Platform in accordance with its professional purpose (managing a travel agency activity);
- Not undermine the operation of the Platform (intrusion attempts, reverse engineering, massive scraping);
- Respect the rights of third parties, in particular regarding the personal data of travelers processed via the Platform;
- Not publish illegal, defamatory or offensive content.
5. Intellectual property
Travelyzer SAS remains the sole holder of all intellectual property rights relating to the Platform (software, trademarks, interfaces, documentation, proprietary AI models).
The user retains ownership of the content they upload or produce via the Platform (programs, customer records, marketing content). A non-exclusive license is granted to Travelyzer SAS for the sole purpose of operating the service.
6. Personal data
Travelyzer SAS acts as a data processor within the meaning of the GDPR for traveler data processed by client agencies via the Platform. The processing terms are detailed in the Data Processing Agreement (DPA) attached to the commercial contract.
For data processed as a data controller (visitors to the public site, prospects), the user may consult the privacy policy at privacy@travelyzer.com.
7. Liability
Travelyzer SAS undertakes to provide the service with professional diligence. Nevertheless, since the Platform incorporates artificial intelligence components, the proposals generated (programs, recommendations) must be validated by a human advisor before being sent to the traveler. Travelyzer SAS cannot be held liable for the direct use of unvalidated AI proposals.
In any event, Travelyzer SAS's liability is limited to the amount of fees actually received over the last twelve months.
8. Termination
The terms of termination of agency accounts are set out in the commercial contract. Travelyzer SAS reserves the right to suspend or terminate access to the Platform in the event of a serious breach of these Terms, after prior notification.
9. Changes to the Terms
Travelyzer SAS reserves the right to modify these Terms at any time. Users will be informed of substantial changes at least 30 days before they take effect.
10. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Paris.
